San Diego Legal Team Wins Large Settlement
In a case handled by a legal team headed by Robert Francavilla, a partner with the San Diego law firm of Casey Gerry, a $1.25 million out-of-court settlement was reached in a lawsuit involving the country’s longest survivor of Amyotrophic Lateral Sclerosis —Lou Gehrig’s disease — a disease in which victims progressively lose muscle control. In the settlement, defendants Troon Golf LLC and The Crosby National Golf Club LLC, agreed to pay more than $1.1 million to Marilyn Cooper, 67, a resident of Northridge. The rest of the settlement was paid by Summers/Murphy & Partners Inc., a landscape architect, and Masson and Associates Inc., an engineering firm.
According to Francavilla, Marilyn Cooper, who has had ALS for 36 years, suffered serious injuries after a fall at the exclusive Crosby Estates’ Sports Center in Rancho Santa Fe north of San Diego. “While driving her motorized wheelchair toward a family reunion celebration, she toppled down a two-step stairway that blended into the background and created an illusion of a flat surface,” Francavilla said. “The change in elevation lacked signage, visual cues and hand rails, and as a result she was unable to see the steps. Our legal team was able to prove that that the defendants clearly chose aesthetics over safety, and violated the California Building Code and ADA requirements, as well as basic common sense in the design and management of the facility, which serves Crosby Estates, a high end residential community.”
Cooper broke her hip in the fall and required multiple surgeries to repair her injuries. Francavilla said the settlement funds will cover medical care and expenses as well as compensate Cooper for the effect the incident will have on her quality of life. The settlement was reached after a full-day mediation conducted by Thomas Sharkey of Judicate West.
Bank of Southern California Raises New Capital
Bank of Southern California has raised $3.1 million in new capital in a private placement of common stock and separately announced that it has received regulatory approval to acquire $24 million in deposits from another institution, Mizuho Corporate Bank of California. The added capital increases the bank’s total capital to $22.7 million, according to Natan Rogge, president and CEO. He said the bank’s total risked-based capital ratio is now 17.6 percent compared to the minimum level of 10 percent required to be considered “well-capitalized.” The bank’s Tier 1 capital ratio has been increased to 11.9 percent. The acquisition of common stock from Mizuho Corporate Bank is expected to close around Aug. 26. it will raise the bank’s total deposits to $179 million and total assets to $207 million. The bank has increased its presence in the region by opening an office in Downtown San Diego and acquiring the Palm Springs and La Quinta offices of Palm Desert National Bank. It has six offices in San Diego County and the Palm Springs area.
SpearHall Increases Staff
SpearHall Advertising & PR has hired Michael Nesbit as vice president of special events and Danielle Hill as graphic artist, and has promoted Stephanie Prebis to account coordinator. Nesbit is a graduate of Methodist University and previously worked for Acushnet Co. He’s responsible for managing SpearHall’s consumer Golf Fest Shows in San Diego, Phoenix and Las Vegas. Hill is a recent Truman State University graduate with a bachelor’s degree in visual communications. Prebis joined SpearHall in 2010 as an event coordiation intern. She is responsible for promoting and marketing SpearHall’s consumer Golf Fest Shows. She attended The Art Institute of California.
GlenView/GlenBrook Administrator Named
Jay Douglas Prince has been appointed administrator for GlenView Assisted Living and GlenBrook Skilled Nursing in Carlsbad. The GlenView GlenBrook health center, located at 1950 Calle Barcelona, provides health care services to the public as well as residents of La Costa Glen, the continuing care retirement community located adjacent to the facility. Prince has been a licensed and practicing nursing home administrator for the past five years. Prior to joining GlenView-GlenBrook, he was the administrator for Vista Grande Villa in Jackson, Mich., and recently won the 2011 American College of Health Care Administrator’s Facility Leadership Award in recognition of his work at that community. Prince was associate administrator for Sumner on Ridgewood in Copley, Ohio, prior to Vista Grande Villa.
